25 cities, counties and states sue EPA over repeal of power plant greenhouse gas standards
A coalition of 25 cities, counties and states sued the EPA on Thursday (Oct. 1, 2026) in the U.S. Court of Appeals for the D.C. Circuit over the repeal of most of the 2024 Carbon Pollution Standards for fossil fuel-fired power plants. The group also filed a notice of intent to sue over the agency's failure to regulate greenhouse gas emissions from existing gas-fired plants, including peaker plants. EPA Administrator Lee Zeldin announced the final repeal in September and proposed rescinding all remaining power sector greenhouse gas standards.
Federal carbon rules for power plants are now in litigation, so builders and AI strategy leads relying on grid power should plan for regulatory uncertainty in the emissions profile of the generation serving their sites.
